§ 12.03.070. Violation; penalties.

  • Each child convicted of a violation of the provisions of this section shall be punished by a forfeiture of not less than twenty-five dollars and/or loss of driving privileges as provided by applicable law. Each adult convicted of a violation of the provisions of this section shall be punished by a forfeiture of not less than fifty dollars, nor more than five hundred dollars, except for a second conviction within a twelve-month period the minimum forfeiture shall be seventy-five dollars; for a third conviction within a twelve-month period the minimum forfeiture shall be one hundred dollars; for a fourth or subsequent violation within a twelve-month period the minimum forfeiture shall be one hundred fifty dollars; and in default of payment thereof, by the loss of driving privileges or another penalty as provided by applicable law.
