§ 15.16.010. Excavation permit required.

  • A.

    No person shall excavate or tear up any street, alley, sidewalk or other public place in the city without having first obtained a permit therefor from the public works director in accordance with the provisions of this chapter. Emergency excavation—in the event an emergency repair of a utility failure is necessary the following sections may be waived: Sections 15.16.010(B) through (F) and 15.16.020 through 15.16.060. The charge for this permit shall be as set forth in the fee schedule on file in the clerk's office.

    B.

    Plans of the work are to be on file with the public works director, including location, size of depth and cut, and materials proposed.

    C.

    Permits may include multiple excavations.

    D.

    The permit holder must certify that he or she and/or his or her contractor has a copy of and understands the latest editions of the following specifications:

    1.

    Wisconsin Department of Transportation Specifications for Road and Bridge Construction;

    2.

    Standard Specifications for Sewer and Water Construction in Wisconsin;

    3.

    Manual of Uniform Traffic Control—Construction Barricading Section.

    E.

    The permit holder must not have more than three violations of this chapter in the previous two-year period.

    F.

    Utility notification must be made in accordance with Section 182.0175 of Wisconsin Statutes.

    G.

    No more than five outstanding permits may exist (including emergency repairs) before another permit is issued. Outstanding permits are those at which location final restoration is not completed to the satisfaction of the city.

    H.

    The requirements of this section may be modified by the public works director as conditions warrant.

    I.

    Privileges in streets which by their extent and duration are subject to Section 66.0425 of the Wisconsin Statutes shall be governed thereby and this section and Sections 15.16.020, 15.16.030, 15.16.040 and 15.16.050 so far as in conflict therewith shall not apply. Section 66.0425 of the Wisconsin Statutes is hereby adopted by reference thereto. Violation of the provisions of Section 66.0425 of the Wisconsin Statutes shall constitute a violation of this section.
